Interested in 13 Rio Rd? You should know that there are LOTS of problems with this property. For starters it has about $170,000.00+ in encroachments on our adjoining lot. It is out intention to soon file a court order to have those encroachments removed. What is encroaching? All of the attributes that you would like about the house, including the long driveway with space to turn around at the end, the large carport, the workshop, and the best feature of the house - the dock and boat hoist. Less notable, but still encroaching, is the entrance landscaping, sprinkler system, and fence across the entire north side of property.
Want to have to tear all of that down? Bank of America didn't nor did the Title Insurance Company, and both have pretty deep pockets. They both refused to take any action on fixing the encroachments since it was such a giant mess. This is why 13 Rio Road is now at auction.
It seems like an amazing deal for a deep water lot on a very desirable street but by the time you have paid for the house (which you cannot get financing for because of the encroachments) and then paid for the repairs you will have spent as much on it as you would have if you had just gone out and bought another deep water property without any title issues and much less headache. We have fought for over a year to get this problem fixed already with no progress. If you still decide that you want 13 Rio Road, you will be dealing with us for a long time too and can count on some hefty attorney fees.
And, no, we are not willing to sell our lot or to sell off just a piece of it. We plan on building on it. In fact, the county already came out to complete their own survey and said that we cannot give you a part of our property without making our own property un-buildable.
Just thought you would want to know before you spent too much time planning only to find out that you have been wasting your time.
Yes, this listing is on auction.com. ID1544279. As of right now, Auction.com hasn't even disclosed the encroachment issues, but they DO exist. The map above highlights how much of the property encroaches onto our property.
